The terms and conditions outlined below are applicable unless not agreed otherwise between the Photographer - Saari Sildos/Soulscape Studio OÜ - and the Client. By making a booking and upon paying the retainer fee (if applicable), the Client agrees to the following terms.

1. Booking & Payment

• A booking is considered confirmed only after a written agreement (email, message, or form submission) and the receipt of a non-refundable retainer fee.
• For portrait sessions, a retainer fee of €50 is required to secure the date.
• Payments are accepted via bank transfer to LHV bank account EE367700771011555514 - recipient Soulscape Studio OÜ - or via cash.
• If the photoshoot will take place in a studio, the studio rent price is to be paid together with the booking fee.
• The remaining balance must be paid no later than the day of the shoot, unless otherwise agreed. Photos shall not be delivered until full payment has been made.
• Event photography may require a 50% deposit, with the rest due on the event date.
• Prices outlined in the portrait packages do not include additional costs such as studio rent, hair, make up or accessories.
• For locations outside of Tallinn, additional transport fees may incur.

2. Cancellations & Rescheduling

• If the Client cancels less than 48 hours before the scheduled session, the retainer is non-refundable.
• Rescheduling is allowed once, free of charge, with at least 48 hours' notice.
• In case of illness, extreme weather (in case of outdoor session), or force majeure, both parties will work together to reschedule the session.
• If the Photographer must cancel for any reason, a full refund (including retainer) will be issued or an alternative date offered.

3. Image Delivery

• The final delivered gallery will consist of fully edited, high-resolution JPEG images, in line with the Photographer's artistic style.
• Edited images of the portrait sessions will be delivered within timelines outlined in the specific package, but no later than 2 weeks after the shoot (unless otherwise agreed).
• For events, delivery time may extend to 3–4 weeks depending on the scope.
• Small selection of a few teaser/highlight photos is available if requested, to be delivered within 48h of the photoshoot.
• Portrait sessions and private events will be delivered via private online galleries that can be easily shared with friends or family.
• Public events (such as concerts or similar) may be shared via online galleries that remain public on the Photographer's website.
• Express delivery (within 3–5 days) may be available at an additional fee.
• The Photographer does not provide RAW or unedited images as part of any package or service. RAW files are considered the Photographer’s working materials and will not be shared, sold, or released under normal circumstances. Requests for RAW files will be reviewed on a case-by-case basis and, if granted, may incur a substantial additional fee.

4. Image Usage & Copyright

• All images remain the copyright of the Photographer.
• Clients receive personal usage rights, which include sharing on social media, printing for personal use, and storing for personal memories.
• Images must not be edited, filtered, or altered in any way that affects the Photographer’s artistic style.
• Commercial use (e.g., advertising, branding, product placement) requires a separate license agreement.

5. Photographer’s Portfolio Use

• The Photographer reserves the right to use selected images for their portfolio, website, social media, and marketing materials.
• If the Client wishes for images to remain private, they must notify the Photographer before the shoot.
• A privacy fee of €50 is applicable for full exclusivity in case of portrait sessions and private events.

6. Client Responsibility

• The Client is responsible for their appearance, styling, and punctuality.
• The Photographer is not responsible for delays due to the Client arriving late and the photoshoot will not be extended because of it.
• If the Client is late for more than 15 minutes and they have not notified the Photographer, the Photographer may leave the site.
• The Client should communicate any special requests, preferences, or sensitivities before the session.

7. Editing & Retouching

• The Photographer provides editing aligned with their artistic style. Extensive retouching (e.g. body modification, background changes) is not included unless explicitly agreed and may incur an additional fee.
• Requests for minor additional edits are accepted within a week of delivery of the photos without extra charges.
• Larger scale edit requests as well as requests for edits after a longer period of time since the delivery of photos may incur an extra fee.

8. Image Storage

• The final images will be stored by the Photographer for 2 months. After this period, retrieval cannot be guaranteed.
• Clients are advised to download and back up their galleries promptly.

9. Conduct & Venue Rules

• The Photographer will always act professionally and respectfully. The same is expected from the Client and guests.
• If the session is in a public or private venue suggested by the Client, it is the Client’s responsibility to secure necessary permissions and inform the Photographer of any restrictions.

10. Liability

• While all care will be taken, the Photographer cannot be held liable for unforeseen technical failures, weather conditions, or force majeure that may affect the outcome.
• In the unlikely event of total photographic failure or cancellation by the Photographer, liability is limited to a full refund of any amount paid.

11. Agreement to Terms

By booking a session or event with the Photographer, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions.
